**Assalamu Alaikum wa Rahmatullahi wa Barakatuh, Mufti Sahab.** Mera ek sawal hai. Main India se bahar ek mulk mein kaam karta hoon, jahan mukhtalif mazhab aur cultures ke log saath kaam karte hain. Un mein se kuch log drink karte hain aur kuch aisi ghizayein bhi khate hain jo Islam mein haram hain, jaise pork waghairah. Office mein kabhi kabhi sab ko saath mein lunch karna padta hai. Wahan ke utensils, jaise glasses, spoons, bowls aur plates, sab log mushtaraka (shared) taur par istemal karte hain. Yani wohi utensils non-Muslim colleagues bhi istemal karte hain aur hum bhi. Mera sawal yeh hai: 1. Kya aise shared utensils ka istemal karna jaiz hai, jab unhein aise log bhi istemal karte hon jo sharab peete hain ya haram ghiza khate hain? 2. Agar utensils zahiri taur par saaf hon, to kya unmein khana ya pani peena durust hai? 3. Agar kabhi office ke taqazon ki wajah se unke saath ek hi table par lunch karna pade, ya kisi wajah se ek hi plate mein se khana pad jaye, to kya yeh Shari'at ke mutabiq jaiz hai? السلام علیکم ورحمۃ اللہ وبرکاتہ محترم مفتی صاحب! فقہِ حنفی کی روشنی میں درج ذیل مسئلے کی وضاحت فرما دیں۔ ایک نکاح اس طرح کروایا گیا کہ کمرے کے اندر صرف لڑکا، لڑکی اور مولانا صاحب موجود تھے۔ مولانا صاحب نے لڑکی سے ایجاب و قبول کروایا، پھر لڑکا یہ کہہ کر کمرے سے باہر چلا گیا کہ وہ باہر جا کر قبول کرے گا۔ بعد میں فون پر رابطہ کیا گیا، لیکن لڑکی کو لڑکے کی آواز واضح طور پر سنائی نہیں دی اور کال بھی منقطع ہوگئی۔ تقریباً آدھے گھنٹے بعد لڑکا واپس آیا، اس نے بتایا کہ نکاح ہوچکا ہے، پھر نکاح نامے پر دستخط کروائے گئے۔ لڑکی کی طرف سے صرف ایک خاتون موجود تھیں، لیکن وہ کمرے کے باہر تھیں۔ لڑکے نے انہیں اندر نہیں آنے دیا اور دروازہ بند کرکے نکاح کی کارروائی انجام دی۔ بعد میں اس خاتون نے بتایا کہ انہوں نے ایجاب و قبول سنا ہی نہیں۔ لڑکے کی طرف سے دو افراد کمرے کے باہر موجود تھے، لیکن بعد میں ان کا بھی یہی کہنا تھا کہ انہیں معلوم نہیں کہ نکاح کس طرح ہوا یا ہوا بھی یا نہیں، کیونکہ انہوں نے ایجاب و قبول نہیں سنا۔ ان کے مطابق وہ اس دوران اپنے موبائل فون استعمال کر رہے تھے اور درمیان میں چائے وغیرہ پینے کے لیے بھی چلے گئے تھے، اس لیے مسلسل وہاں موجود بھی نہیں تھے۔ مزید یہ کہ نکاح کے وقت مہر بھی متعین نہیں کیا گیا، بلکہ یہ کہا گیا کہ بعد میں دونوں خاندان باہمی مشورے سے مہر طے کر لیں گے۔ درج ذیل سوالات کے جواب مرحمت فرمائیں: 1. کیا فقہِ حنفی کے مطابق مذکورہ صورت میں نکاح شرعاً صحیح اور منعقد ہوا تھا یا نہیں؟ 2. اگر گواہوں نے ایجاب و قبول نہ سنا ہو، یا بعد میں یہ کہیں کہ انہیں معلوم ہی نہیں کہ نکاح ہوا یا نہیں، تو اس صورت میں شرعی حکم کیا ہوگا؟ 3. اگر ایسی صورت میں نکاح شرعاً ثابت ہی نہ ہو، تو کیا طلاق واقع ہوگی؟ 4. کیا ایسی صورت میں عورت پر عدت لازم ہوگی؟ براہِ کرم قرآنِ کریم، احادیثِ مبارکہ اور فقہِ حنفی کی معتبر کتب کے حوالوں کے ساتھ مدلل رہنمائی فرما دیں۔ واللہ أعلم بالصواب
